Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of OurTruth (the "Service"). The Service is operated by Overtone Studios LLC ("Overtone Studios," "we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Use of the service

You may use the Service for personal or commercial purposes, provided your use complies with these Terms and applicable law. You agree not to:

• Use the Service to harass, defame, or harm others.
• Attempt to reverse-engineer, scrape, or abuse the API.
• Use automated means to submit large volumes of claims.
• Circumvent rate limits or access controls.
• Use the Service in violation of any law, regulation, or third-party rights.

3. Accounts

You are responsible for maintaining the security of your account and for activity that occurs under your credentials. You must provide accurate information when registering and keep it up to date. We may suspend or terminate access to the Service if you violate these Terms, create risk for users, or expose us to legal liability.

4. AI and accuracy disclaimer

OurTruth uses AI and third-party data providers to evaluate claims. Outputs are provided for informational purposes only and may be incomplete, outdated, or incorrect. We do not guarantee the accuracy, completeness, or timeliness of any output. The Service is not legal, medical, financial, investment, or other professional advice, and you should not rely on it as your sole basis for important decisions.

5. Intellectual property

The OurTruth name, logo, and software are owned by Overtone Studios LLC or its licensors and are protected by applicable intellectual property laws. Claims and other content you submit remain yours. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, analyze, and use that content as needed to operate, secure, improve, and provide the Service.

6. Third-party services

The Service depends on third-party providers (including model, search, hosting, and authentication providers). We are not responsible for outages, errors, content, or other acts or omissions of third parties.

7. Indemnification

You agree to defend, indemnify, and hold harmless Overtone Studios LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

8. Disclaimer of warranties and limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Overtone Studios LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of the Service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, the total liability of Overtone Studios LLC for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) USD $100.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access as described in these Terms. Sections that by their nature should survive termination will survive, including intellectual property, indemnification, warranty disclaimers, limitations of liability, and governing law and venue provisions.

10. Governing law and venue

These Terms and any dispute related to the Service are governed by the laws of the State of Texas, without regard to conflict of law principles. You and Overtone Studios LLC agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in Texas, except where prohibited by law.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and may provide additional notice. Continued use of the Service after changes become effective means you accept the updated Terms.
